Terms of Service

These terms of use apply when you use the services of the Robin system provided by The Key Support Services Ltd. The Robin system includes software, tools, developer services, data, communications, documentation and websites related to our main website at https://robin.education (‘Services’).

Accessing our Services

You must provide accurate and complete information to register for an account. You must not make your access credentials or account available to others, and you are responsible for all activities that occur using your credentials.

You must have the authority to register and accept the Terms on behalf of the School, Trust or other relevant organisation (‘Organisation’) that you belong to and register against.

If you choose, or you are provided with, a user identification code, password, or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party.

We have the right to disable and delete any user account and all data linked to them, whether chosen by you or allocated by us, at any time if in our opinion you have failed to comply with any of the provisions of these terms of use or if we believe there is or may be a security breach. We also have the right to recoup all loss of income resulting from your failure to comply with any of the provisions of these terms of use.

Access to the Services is permitted on a temporary basis. We will not be liable if for any reason our Services are unavailable at any time or for any period. From time to time, we may restrict access to the Services to users, including those who have registered with us.

Inputs and content

We use a range of technologies including artificial intelligence to process input information (‘Input Information’) and generate output content for you and your Organisation (‘Content’).

Input Information falls into two categories:

  • Publicly available information about your Organisation, for example from your Organisation’s websites and from the Department for Education.
  • Other systems, content, and data sources that you, or someone else in your organisation, provide to us directly, or authorise access to.

You give consent for us to collect, store and process this Input Information in order to provide our Services.

You are responsible for the Input Information you provide, including for ensuring that it does not violate any applicable law or these Terms.

You understand that the Content we provide may be inaccurate. You should always review the Content and validate the results before using them.

You must not represent that our Content was human-generated when it is not.

Prohibited uses

You may use our Services only for lawful purposes. You may not use our Services:

  • In any way that breaches any applicable local, national or international law or regulation.
  • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
  • For the purpose of harming or attempting to harm any other persons in any way.
  • To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware. You also agree:
  • Not to reproduce, duplicate, copy or re-sell any part of our Services in contravention of the provisions of our terms of use.
  • Not to access without authority, interfere with, damage or disrupt: any part of our Services; any equipment or network on which our Services are stored; any software used in the provision of our Services; or any equipment or network or software owned or used by any third party.

Fees and payments

You will pay all fees charged to your account (‘Fees’) according to the prices and terms on the applicable pricing or order page, or as otherwise agreed between us in writing.

You will provide complete and accurate billing information including a valid and authorised payment method for your Organisation.

You authorise The Key Support Services Ltd and its affiliates, and our third-party payment processor(s), to charge your payment method for the Fees. If your payment cannot be completed, we will provide you written notice and may suspend access to the Services until payment is received. Payments are non-refundable except as provided in these Terms.

We may change our prices by notifying you and/or updating our websites. Any price changes will apply to the Fees charged to your account immediately after the effective date of the changes.

We have the right to correct pricing errors or mistakes even if we have already issued an invoice or received payment.

If you want to dispute any Fees, please contact [email protected] within thirty (30) days of the date of the disputed invoice.

If any amount of your Fees are past due, we may suspend your access to the Services after we provide you written notice of late payment.

Governing law

You hereby accept the application of the laws of England to govern matters between us.

Disclaimer

Neither The Key Support Services Ltd. nor any of its employees, agents or sub- contractors make any warranty, expressed or implied, or assume any legal liability or responsibility for the accuracy or completeness of any information delivered by the Services, or that the availability of the Services will be uninterrupted.

Nothing in these terms of use or other documentation limits our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation nor any other liability which cannot be excluded or limited under applicable law, nor does it affect or limit any statutory rights you, the user, may have as a consumer.

Revisions

The Key Support Services Ltd. reserves the right to revise, withdraw or restrict access to the Services in whole or in part at any time without prior notice. Please check this page periodically for changes. Your continued use of the Services following the posting of changes to these Terms of Use means that you accept the changes.
